You agree to hold FantasySportsBaseball.com harmless from all typographical, statistical, transaction, and communication errors or omissions. FantasySportsBaseball.com or any subsidiary or affiliated company of any of the foregoing, are not in any way responsible or liable for any damage, loss, injury (including death), or expenses incurred by a contestant as a result of enrolling, playing, or winning the Fantasy Baseball Challenge.

FantasySportsBaseball.com reserves the right to make any changes, in its sole and absolute discretion, deems necessary to the contest and rules as the season progresses.

All taxes associated with prize winnings are the sole responsibility of the winner.

3. Game of Skill: THIS IS A GAME OF SKILL. WINNERS WILL BE DETERMINED BY THE OBJECTIVE CRITERIA SET FORTH BELOW. From all eligible entries received, the winners will be determined based on their ability to use their skill and knowledge of the relevant MLB Baseball and FantasySportsBaseball.com Fantasy Baseball Challenge rules to accumulate the most adjusted points during the term of FantasySportsBaseball.com Fantasy Baseball Challenge 2007 according to the official contest rules. The term in which points can be accumulated runs from beginning of MLB 2007 season through the end of the MLB 2007 World Series games. Points from any regular season games played on or before April 2, 2007, will not be used. The FantasySportsBaseball.com Fantasy Baseball Challenge cannot be used in connection with any form of gambling.

4. Eligibility: The FantasySportsBaseball.com Fantasy Baseball Challenge is open to individuals who have reached legal age in their respective jurisdiction. Individuals who have not reached legal age in their respective jurisdiction can enter only with permission of a parent or legal guardian. There is no limit to the number of fantasy teams (entries) allowed by an individual in the Fantasy Baseball Challenge.

Contestants must be able to pay league fees in a currency accepted by PayPal, Inc. and must have a valid email address. You must provide your name, address, city, state, zip code, country, currency, phone number, e-mail address, team name, and username to enroll. After your league fee has been verified, you will be granted access to the game. Once logged into the game, you must choose your team's player roster via the drop down boxes provided on the player selection page. Each entry submitted will compete against all other entries eligible to compete for prizes in any given Fantasy Baseball Challenge period.

FantasySportsBaseball.com takes no responsibility for misdirected entries or for entries that are lost, damaged or corrupted in the web transmission. FantasySportsBaseball.com reserves the right to disqualify any entry that has been incorrectly completed or contains invalid or incorrect information. Employees and immediate family members of FantasySportsBaseball.com, its sponsors, affiliates, subsidiaries, advertising and promotional agencies are not eligible to win prizes. 5. Internet/Technology Problems: If, for any reason, the FantasySportsBaseball.com Fantasy Baseball Challenge is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of FantasySportsBaseball.com which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Fantasy Baseball Challenge, FantasySportsBaseball.com reserves the right at its sole discretion to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the Fantasy Baseball Challenge.

FantasySportsBaseball.com assumes no responsibility for any error, omissions, interruption, deletion, defect or delay in operation with transmission, communications, line failure, theft or destruction or unauthorized to contest activities conducted or information transmitted via the Internet. FantasySportsBaseball.com is not responsible for any problem or technical malfunction of any telephone network or lines, computer online systems, cable network, cable line, servers, equipment or software, failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet or at any web site, phone lines, or any combination thereof, including any injury or damage to a participant's computer related to or resulting from participation in this Fantasy Baseball Challenge.

CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE FANTASY BASEBALL CHALLENGE IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, FANTASYSPORTSBASEBALL.COM RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.

If for any reason FantasySportsBaseball.com experiences technical difficulty with the online trading database, changes to the rosters will not be taken until the online trading database is reopened. If for any reason (including, but not limited to, strikes, lockouts, acts of God, technical difficulties, governmental intervention, and other events not within the reasonable control of FantasySportsBaseball.com) Major League Baseball experiences a work stoppage and/or FantasySportsBaseball.com cannot, in its best business judgment, reasonably continue the Fantasy Baseball Challenge, then FantasySportsBaseball.com Fantasy Baseball Challenge will not resume until both Major League Baseball resumes its schedule and FantasySportsBaseball.com resumes normal business, if ever.

6. Errors: FantasySportsBaseball.com shall act as Commissioner for all leagues, and shall have the authority to rule on all aspects of the Fantasy Baseball Challenge. If, for any reason, an error in scoring or win/loss records or point totals occurs, it is the sole responsibility of the participant to inform The Commissioner of the error within four working days of the occurrence. FantasySportsBaseball.com will do all it can to remedy the error. The FantasySportsBaseball.com Baseball Commissioner has the final say in all disputes.

7. Refund Policy: FantasySportsBaseball.com does not provide refunds. Contestants that do not show up to update their rosters are solely responsible for allowing their Fantasy Team(s) to become uncompetitive in their league.

8. Notification: Winners of the FantasySportsBaseball.com Fantasy Baseball Challenge are notified by email or regular mail within 30 days after the official final league and overall results (and associated winners) are posted at the conclusion of the Fantasy Baseball Challenge. Winners are also posted on the FantasySportsBaseball.com web site.

In the event of dispute about the identity of any entrant, entries made online are declared made by the authorized account holder of the email address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. A potential winner can be required to provide the sponsors with proof that the potential winner is the authorized account holder of the email address associated with the winning entry.
